Subject:- MEMORANDUM ON THE Plight of Engineers on   Railways   &     Retrograde  REPORT OF SIXTH PAY COMMISSION

 
Hon’ble Sir,

N.C.R.E.A. is the organisation, i.e. representing the category of Degree / Diploma (JE/ SE /SSE ) Engineers of Railways. Organisation is affiliated to All India Railway Engineers Federation (AIREF), which is the sole representative body of 80000 Railway Engineers / CMS / DMS / IT persons over Indian Railway.  In continuation of our Federation memorandum submitted time to time, NCREA once again draw your kind attention towards the plight of Engineers on Railways & continuous injustice since 3rd CPC and again by the retrograde Report of the Sixth Pay Commission – especially in respect of their Pay Scales (Pay Bands & Grade Pays), Avenues of Promotion to Group B and A and worst Service Conditions etc.

 

As already submitted, many of the Railway Engineers left the Rly. Service due to wide spread frustration amongst the category, which has further accentuated due to the retrograde recommendations of the Sixth Pay Commission, which is getting further compounded on viewing RBE No. 124/2008, under which many categories are upgraded and subordinate Engineers are ignored once again. Rly. Engineers are worried due to further non-implementation of favourable recommendations like Group B status to all JE/SE/SSE (PB-2), delay in 3 modified ACP and 2-tier AC entitlement under pass rule etc.

It is therefore once again requested that the issues raised in the enclosed Memorandum regarding provision of group B gazetted status, modified ACP & upgraded pay scales to all existing JE/SE/SSE may very kindly be considered favourably early.

MEMORANDUM ON THE Plight of Engineers on Railways

& RETROGRADE REPORT OF SIXTH PAY COMMISSION

There is a great discontentment amongst the technocrats in general and Engineers / Technical Supervisors on Railways in particular due the humiliation suffered by them especially at the hands of the sixth Pay Commission equating them with non-technocrats.

Only 3 groups of Government employees viz. Defense staff, Scientist and Technocrats were much agitated over SCPC recommendations. Government has approved the recommendations of SCPC with minor modifications and given some relief to both defense staff and scientists leaving the claims of technocrats unaddressed.

It is needless to point out that the Technocrats are the base and prime element in any field, building up nation’s prosperity with enhanced performance in GDP growth. The country cannot afford to face even a little disturbance in the working system of Technocrats especially in Indian Railways. If the discontentment rises and the technocrats just observe work to rule the impact will be quite adverse and as responsible citizens we fully realize it.

It is need not to say that JE / SE / SSE are playing a vital role to maintain Assets, safety, productivity, Stores, punctuality and their functioning like middle management can not be denied. They have round the clock duty under excluded classification in HOER but they have been rewarded for their intellectual service by giving grades below non-technical persons, those are far behind them in past. The work assigned to them required more skills, educations, intellectual level, accuracy, more vigilance, more strain & their services are more dedicated / profitable to Rly. compared to Nurse / Teachers / Account peoples, those have been upgraded by the Rly. Board.  

Most of the other major demands of the employees and Rail Engineers had also not been accepted there by increasing their frustration and hardship. In fact the Engineers on the Railways were the worst hit due to this apathetic attitude of the Railways & the Government, as many of the anomalies and disparities by the previous Pay Commission(s) have not been removed and even some of the agreed upon items as well as recommendations of high powered Commissions & Committees have also not been implemented, in their case.

It is therefore, requested that the following genuine demands may please be accepted in the interest of natural justice and to mitigate the extreme hardship and frustration of the employees especially amongst the Rail Engineers:-  

Demand for upgraded scales and Group B status

1) Placing all SEs, SSEs & Group ‘B’ in PB-3 - As in other Central Government Departments like CPWD and MES, and in most State Government - where the JEs are promoted directly to Group B Gazetted without any intermediate grade. The difference in grade pay of Rs 4200 & Rs 4600 - in the first two slabs of PB-II - is very meager (Rs.400 only) which is most unscientific while considering the variations in the work content, responsibilities and accountabilities. It is requested that this anomaly can be routed out by placing this cadres ( especially the Engineers / Technical Supervisors) in PB-II with grade pay of Rs.4600  be upgraded to PB-III - with the Grade pay of Rs.5400 by duly upgrading the entry grade of Graduate Engineers (UPSC candidate) being placed in the next higher grade pay in PB-III.

Presently a new recruit with Diploma in Engineering qualification and a Degree in Engineering is differentiated in the basic pay by 10 increments, which is now reduced to 8 increments which is unfair and unjust. Hence the entry grade of Engineering Graduate whose scale is merged with the pre- revised scale of Rs.7450-11500 be upgraded to PB-III with the Grade pay of Rs.6600.(Annexure-I)

Since independence the supremacy and the importance of the Technocrats in the apex grade of Technical cadre pre-revised S-13 are systematically degraded and presently it has come to the situation that the senior most educated and efficient employees in this cadre are totally demoralized. Government is requested to redress their grievance by placing them in PB-III with the Grade pay of Rs.6600.

The technical employees should be differentiated from non-technical employees in Railways at least by granting 30% of pay band as special pay as done in the case of scientist, whose special pay has been doubled by the Government.

 

       iii) Up-grading of S.S.Es. to pre-revised scale of Rs. 10000-15200

      - Being the principal custodian of vast Railway properties and considering their duties, responsibilities and accountabilities shouldered by them, JEs are getting the post of SSE (Rs 7450-11500) after 20-24 year of service whereas, in other Departments, the scale of Rs. 10000-15200 is given to JE on time Bound basis in 24 year of service.

      iv) Up-grading of JEs to pre-revised scale Rs 7450-11500 (As proposed by SCPC for Nurse/teachers).

2. Group ‘B’ Gazetted status to all JEs., SEs.& SSEs. All the previous three Pay Commissions had recommended for classification of the Pay Scales of senior Technical Supervisors to be classified in Group B and the Government had also accepted the recommendations in this regard, except in case of Fifth Pay Commission wherein the Government had modified the recommendations  But the Railways did not implement any of the orders issued after any of the 3 Pay Commissions.

 

In comparison to other departments and all India Average, Railways is having lowest number of gazetted posts (Please see Annexure I & II - Table showing comparative percentage of Group B Posts on Railways & other Departments and with Justification for grant of Group B status), which will hamper and slow down the activities of huge investment besides adversely effecting the efficiency and safety on the Railways.

 

Sixth Pay Commission has clubbed all the existing scales of Technical Supervisors (JEs, SEs, SSEs / CMS/ DMS) in existing scales of Rs 5000-8000, Rs 5500-9000, Rs 6500-10500, Rs 7450-11500, and Group B in existing scales of Rs 7500-12000 and 8000-13500, in PB-2. Since the nature of job in all these scales requires supervision and management, it is requested that these posts be classified in Group B gazetted as has already been done in other Central Government Departments as well as in most other State Government services.

 

3.       i)Time Bound promotions from J.E. to AE up to J.A. grade & abolish 3 tiers for the post of  AEN i.e. PB-2 GP Rs. 4800 & 5400  also PB-3 GP Rs.5400

 

 ii)  Reduction in number of scales of Technical Supervisors on Railways from Junior Engineers  to Asstt. Engineer (Group B Gazetted) & Clubbing of SE/SSE - at par with MES, CPWD and many states Government organizations.& as per the pattern recommended by SCPC in its report for Railways (As per Para 7.36.77).

4. a) 3 financial Up-grading under Modified ACP for Junior Engineers after every 8 years i.e. after 8, 16 & 24 years of service in a grade as decided for the Defence personnel & upgrade structure for promotion for JE, so that JE will get grades of Asstt. Engineer / Ex. Engineer & Suptt. Engineer under modified ACP scheme like wise other JE, who are enjoying previously & will get now in other Central Govt. Deptt. and in many State Govt. services also.

   Considering the upper age limit for post of Junior Engineer is 35 years, which equates to maximum 25 years of service before retirement.

b)  Merged / abolished grades should not be counted as promotion under modified ACP, since it  will only effect the JEs of railway, since existing 5 grade structure from JE to AE was existing in Railway only, there should not be any intermediate grades in between JE and AE now.

      JEs are to be placed in PB-2, i.e. for group B as per SCPC recommendation, hence cadre structure promotion rules of Railway Engineers should be simplified like time bound etc, as in other deptt., to avoid complications, questions / quarries in RTI and avoiding thousands of court cases due to administrative failures.

The detailed justifications to the demand raised above are enclosed as annexure I to IV


Annexure I

 

JUSTIFICATION FOR INCREASING THE NUMBER OF GAZETTED POST BY COMPARING WITH THE OTHER DEPARTMENTS

           All the previous three Pay Commissions had recommended for classification of the Pay Scales of senior Technical Supervisors to be classified in Group B and the Government had also accepted the recommendations in this regard, except in case of Fifth Pay Commission where in the Government had modified the recommendations. But the Railways did not implement any of the orders issued after any of the 3 Pay Commissions.

·                     Sixth Pay Commission had clubbed all the existing scales of Technical Supervisors (JEs, SEs, SSEs / CMS/ DMS) in existing scales of Rs 5000-8000, Rs 5500-9000, Rs 6500-10500, Rs 7450-11500, and Group B in existing scales of Rs 7500-12000 and 8000- 13500, in PB-2. Since the nature of job in all these scales requires supervision and management, it is requested that these posts be classified in Group B gazetted, as has already been done in other Central Government Departments as well as in most other State Government services.

·                     In comparison to other departments and all India Average, Railways is having lowest number of gazetted posts (as per detailed figures given in the Table attached herewith), which will hamper and slow down the activities of huge investment besides adversely effecting the efficiency and safety on the Railways.

·                     The capital at charge of Indian Railways has risen from Rs.827 crores in the year 1950-51 to Rs.66611 crores in the year 2006-07. An increase of nearly 80 times.

·                     According to the Budget speech of Honourable Minister for Railways, Railways would have to make heavy investments for the expansion of the network, modernization and upgradation of the technology and for providing world class facilities to the customers in the coming years. For this purpose, Railways have made a plan to invest Rs. 2,50,000 cr, within the next 5 years.

·                     The planned investment in the next five years will be four times of the existing capital at charge.

·                     With the huge funds going to flow in for the infrastructure and technological developments of Railways & hence, it is very much important to have more number of decision making posts in the technical category.

·                     Subordinate Engineers of Indian Railways are recruited in the Grade Rs. 5000-8000 and after 30 to 35 years arduous service day & night, shouldering huge direct responsibility of Crores of Rupees worth Stores, Heavy Establishment of hundreds of staff and ensuring safe and smooth running of trains retire in the Group ‘C’ Grade of RS. 7450-11500, whereas in CPWD/ MES and State Governments the Subordinate Engineers progress very fast. It may be worth noting that while the scale of recruitement of Diploma / Graduation qualified perssonnel in Indian Railways and State Governments is on par, yet the career of Railwaymen ends at a scale which others reach almost nearabout midpoint of their career. Thus Subordinate Engineers in Railways perpetually lag behind their similarly qualified counterparts.

  • It is very important from the point of view of the Government to increase the Gazetted posts.
  • It is therefore once again requested that the Railways should place at least all the Senior Subordinate Engineers (SSE) in Group B / A with in PB-3 & pay scale Rs.10000-15200 (GP-6600), to keep them at par with other JE. Or at-least in GP-5400.

Restructuring / Up-grading of Group C to Group B & Group A as proposed above, as a case study but it will ensure better motivation & efficiency on the Railways.

ANNEXURE -  III

THE HUMILIATION FACED BY SECTION ENGINEERS IN GETTING RIGHTFUL PAY SCALE RIGHT FROM 4TH CPC.  

Many categories those were in the scale of Rs. 2000 – 3200, granted by 4th CPC were provided with Gazetted pay scale of RS.7500-12000 and Rs.8000 – 13500 by 5th – CPC where as Section Engineers in the scale of Rs.2000 – 3200 and even the Senior Section Engineer in the scale of 2375 – 3500 were granted only a non Gazetted pay scale of Rs.6500 – 10500 and Rs.7450 – 11500 respectively. Even 6th – CPC has denied the Gazetted scale to these two technical categories which is unjust.

THE HUMILIATION FACED BY JUNIOR ENGINEERS IN GETTING RIGHTFUL PAY SCALE RIGHT FROM 4TH CPC.  

Many categories even in Railways, who are in the scale of Rs.425 – 700 by the 3rd – CPC were elevated with two grade upgradation and placed in the scale of 2000 – 3200 by the 4th – CPC where as the Junior Engineers were placed in much lower scale of Rs.1400 – 2300. Adding fuel to the fire 5th – CPC did great in justice to JEs and granted only Rs.5000 – 9000 while around 36 categories were placed with at least up gradation and in some cases even two grade up gradation.

  • The Jr. Engineers are further deprived by neglecting their role and responsibilities and awarded grade Rs. 5000-8000 with GP-4200, where as teachers and Staff nurses with same grade have been placed in upgraded pay scale of 7450-11500 with GP 4600.  
  • Since, JEs in Railway have not been awarded any upgraded pay scales and nor they have scheme of ACP like wise in other central Govt Deptt. or like many state Govt., hence they are very much fad up, being in great loss in grades / basic pay compared to their counter part JEs. Now the situation is that the JE in Railway with same qualification and date of appointment are having huge variation in their basic pay, with other JE in State Govt. and JE without any great upgradation scheme can never touch the scale already got by JE of other than Railways.  
  • JE-II and JE-I of Railway should at-least be given the upgraded scale equal to 7450-11500 with Grade pay 4600 to meet out (Compensate) the huge differences already established in basic pay due to policy differences for JEs in Railway and other Central Govt. Deptt. and State Govts.

Sir, Kindly provided Gr. 7450-11500 to all JE and Grade Pay Rs.4600, considering above facts
